I. General provisions.
- This document sets out the privacy policy, including the collection of cookies and the processing of personal data, applicable to the website.

Kochanowskiego 30, 33-100 Tarnów, NIP (Tax Identification Number): 8733042731 - Unless otherwise specified herein, the definitions and terms used in this Privacy Policy retain the meanings indicated in Rules and Regulations of Jagodowa Osada Cottages.
II. Protection of personal data
- The administrator of personal data (within the meaning of Article 4(7) of the GDPR) of customers booking cottages at “Jagodowa Osada” located in Kościelisko, ul. Borek 25, 34-514 Dzianisz, is Piotr Stolarczyk – an entrepreneur conducting business activity under the name JMP PIOTR STOLARCZYK, ul. Kochanowskiego 30, 33-100 Tarnów, NIP: 8733042731 (hereinafter referred to as: “Administrator”).
- Customers’ personal data may be processed for the following purposes and on the following legal grounds:
- accepting reservations for the “Jagodowa Osada” cottages and processing reservations (legal basis for data processing: Article 6(1)(b) of the GDPR),
- ongoing communication regarding matters related to reservations, including their confirmation and providing information about reservation rules (legal basis for data processing: Article 6(1)(b) of the GDPR),
- handling complaints related to reservations at the Jagodowa Osada cottages (Article 6(1)(b) of the GDPR),
- considering and investigating claims, which constitutes the legitimate interest of the Administrator (legal basis for data processing: Article 6(1)(f) of the GDPR),
- conducting statistical analyses, which constitutes the legitimate interest of the Controller (legal basis for data processing: Article 6(1)(f) of the GDPR),
- data storage for archiving purposes and for the purpose of demonstrating compliance with the legal obligations incumbent on the Controller, which constitutes its legitimate interest (legal basis for data processing: Article 6(1)(f) of the GDPR),
- storing data in the form of cookies, collecting data from the website www.jagodowaosada.pl (provided that this information constitutes personal data) – if the Customer has given separate consent to this on the terms specified in Chapter III.
- sending commercial information electronically in the form of a Newsletter – if the Customer has given separate consent to receive commercial information electronically;
- Customers’ personal data may be disclosed to the following categories of recipients:
- subcontractors providing technical support to the Administrator in the operation, maintenance, and development of Jagodowa Osada Cottages, such as: entities servicing Jagodowa Osada Cottages entities providing technical support for the website www.jagodowaosada.plwith whom the Administrator has concluded legally required agreements for the processing of personal data;
- entities supporting the Administrator in the implementation of applicable laws and regulations and the rights and obligations arising from Rules and Regulations of the Jagodowa Osada Cottages law firms and accounting firms;
- Customers’ personal data will not be transferred by the Administrator outside the European Economic Area (EEA).
- The personal data obtained will be stored by the Administrator for the duration of your stay at the Jagodowa Osada Cottages and, in addition:
- for the time necessary to pursue specific claims made by the Administrator or to refute them (if the claims were made by the Customer)
- for the duration of performing duties arising from legal provisions,
- for the period necessary for the Administrator to document before public administration bodies, including the supervisory authority for personal data protection, the proper fulfillment of its legal obligations,
- for archiving purposes, when it concerns the history of correspondence and responses to inquiries—for a period not exceeding 3 years from the date of data collection,
- until the consent to data processing is withdrawn or the data becomes outdated (as determined by the Administrator) – if data processing is carried out with the consent of a specific person.
- The administrator guarantees each customer the right to exercise all their rights under the GDPR, i.e. the right to request access to their personal data, the right to rectify, delete, or request restriction of processing, the right to transfer data, as well as the right to object to its processing, on the terms and in the cases provided for in the provisions of the GDPR.
- In the case of personal data processing by the Administrator for the purpose of pursuing legitimate interests (as mentioned above), each Customer has the right to object to the processing of data for reasons related to their particular situation.
- In the case of personal data processing by the Administrator with the consent of the Customer, each person has the right to withdraw their consent to the processing of their data at any time without affecting the lawfulness of the processing of such data that took place prior to the withdrawal of consent.
- Providing personal data in relation to:
- Customers who book Jagodowa Osada cottages by email, phone, or via the website www.jagodowaosada.pl– in order to submit and enable the Administrator to process the reservation, it is necessary to provide the following data: first name, last name, address, e-mail address, telephone number. Failure to provide this data will result in the reservation not being accepted.
- Customers who collect their reservations for the “Jagodowa Osada” cottages on site – in order to submit and enable the Administrator to process the cottage reservation, it is necessary to provide the following data: first name, last name, address, e-mail address, telephone number, PESEL (Personal Identification Number), series and number of identity card. Failure to provide this information will result in the inability to accept the reservation.
- Customers who submit complaints in connection with reservations at Jagodowa Osada Cottages – in order to submit a complaint and enable it to be considered by the Administrator, it is necessary to provide the following data: first name, last name, email address, home address, and phone number. Failure to provide this data will prevent the Administrator from considering the complaint..
- other cases – it is voluntary.
- The administrator will not process Customer data in an automated manner that would lead to decisions being made that have legal consequences or similarly significantly affect their situation. Any automated data processing, including profiling, will be used solely for the analysis and forecasting of the individual preferences of Customers using the website. www.jagodowaosada.pl.
- Any person whose personal data is processed by the Administrator has the right to lodge a complaint regarding the processing of their personal data with the supervisory authority, which is the President of the Personal Data Protection Office.
III. Cookie policy
- This cookie policy sets out the rules for the use of small files, known as “cookies,” used by the website managed by the Administrator.
- Cookies are small text files that are saved and stored on devices through which the Customer uses the website. Cookies usually contain the name of the domain from which they originate, the time they are stored on the Customer’s end device, and an individual, randomly selected number identifying the file. The main purpose of cookies is to make it easier for the Customer to use websites and to make them more customer-friendly, without causing any damage to the Customer’s computer or other end device.
- Cookies are safe for the Customer’s computers. In particular, it is not possible for viruses or other unwanted software or malware to enter the Customer’s computer in this way.
- Information collected using files of this type is stored for the purpose of maintaining the Customer’s session on the website, may improve the website by making estimates regarding website usage statistics, helps to tailor the services offered by the Administrator to the individual preferences and actual needs of Customers, and speeds up the search process.
- Basically, two types of such files can be stored on the Customer’s device: first-party cookies (cookies created by the website visited by the Customer – these cookies primarily enable the website to function properly, including the display of its individual elements – disabling them may limit or completely prevent the display of website content) and external cookies (cookies created by external websites, provided by third parties, are installed on the Customer’s device and remain there until they are deleted or expire).

- Essential – Essential cookies are critical for the basic functionality of the website, and the website will not function as intended without them. These cookies do not store any personally identifiable information.
- Functional – Functional cookies help perform certain functions, such as sharing website content on social media platforms, collecting feedback, and other third-party functions.
- Analytical – Analytical cookies are used to understand how customers interact with the website. These cookies help provide information on visitor metrics, bounce rate, traffic source, etc.
- Uncategorized – Other cookies that are being analyzed and have not yet been classified in any category.

- Regardless of the cookie preference management tool provided by the Administrator, the Customer may independently and at any time change the settings for cookies, specifying the conditions for their storage and access by cookies to the Customer’s device directly through the web browser settings. These settings can be changed in particular in such a way as to block the automatic handling of cookies in the web browser settings or to inform the Customer each time they are placed on the Customer’s device. - The customer may delete cookies at any time using the functions available in the web browser they are using.
- The website managed by the Administrator may contain links and references to other websites (managed by other entities). The Administrator is not responsible for the privacy policies applicable to those websites.
- The Privacy Policy may be subject to change, of which the Administrator will inform Customers 7 days in advance.
