Terms and conditions for booking cottages at Jagodowa Osada

I. General provisions

  1. These terms and conditions set out the rules for renting the “Jagodowa Osada” cottages located in Kościelisko, ul. Dzianisz 48A-48E, 34-514 Kościelisko.
  2. Definitions used in the Terms and Conditions:
    1. Terms and Conditions – these Terms and Conditions, setting out the rules for booking and use
      from the “Jagodowo Osada” cottages.
    2. Cottage – a building located on the premises of the Jagodowa Osada Cottages
    3. Accommodation fee – fee for staying in the cottage, available on the website www.jagodowaosada.comin the reservations department. The fee for your stay includes all utility charges, cleaning products, toiletries, and services available to guests, including the use of a hot tub, barbecue, fire pit, and playground.
    4. Customer – a natural person, legal entity, or organizational unit without legal personality that has made a reservation for the Cottage.
    5. Landlord – Piotr Stolarczyk – entrepreneur conducting business activity under the name JMP PIOTR STOLARCZYK, ul. Kochanowskiego 30,
      33-100 Tarnów, Tax Identification Number (NIP): 8733042731.
    6. Reservation fee – prepayment for your stay in the Cottage in the amount of 30% or
      100% of the accommodation fee, paid when booking the cottage according to the customer’s choice.
  3. Making a reservation and paying the Reservation Fee constitutes acceptance of the provisions of these Terms and Conditions.

II. Cabin Reservation

  1. Reservations can be made:
    1. through the online booking system on the website www.jagodowaosada.comin accordance with the available booking form.
    2. By phone at +48533252445, providing the following information: first and last name/name of the customer, number of guests, including the number of children. For children, please provide their age, exact dates of stay, and the customer’s email address.
    3. By email at: info@jagodowaosada.com  providing the following information: first and last name/name of the customer, number of guests, including the number of children. In the case of a child, please provide their age, exact date of stay, and the customer’s email address.
    4. through selected booking platforms where the Jagodowa Osada cottages are available.
  2. After making a reservation, a confirmation of the preliminary reservation of the Cottage will be sent to the Customer’s e-mail address, along with detailed information about the reservation. In each case of reservation, the Customer may choose to pay a Reservation Fee of 30% or 100% of the Fee for the stay.
  3. If the Customer pays a reservation fee equal to 100% of the accommodation fee, the Customer is not entitled to cancel the reservation. In the event of cancellation, the reservation fee will not be refunded.
  4. If the Customer pays a reservation fee of 30% of the total cost of the stay, the Customer has the right to cancel the reservation no later than 14 days before the planned date of arrival, as indicated by the Customer during the initial reservation of the Cottage. In this case, the reservation fee will be refunded in full. Later cancellation of the reservation will result in the non-refund of the Reservation Fee.
  5. If the Customer fails to pay the reservation fee within 2 business days of receiving the preliminary reservation confirmation for the Cottage by email, the preliminary reservation for the Cottage will be canceled.
  6. Once the Reservation Fee has been credited to the Lessor’s account, the Customer will receive an e-mail confirming payment of the Reservation Fee and detailed information about the Cottage reservation.
  7. If the Customer has paid a reservation fee of 30% of the total cost of the stay, the Customer is obliged to pay the remaining amount in cash upon check-in at the Cottage or by bank transfer before check-in at the Cottage, sending confirmation of the transfer to the following email address by the date of check-in at the Cottage: info@jagodowaosada.com.   
  8. Shortening the length of stay in the Cottage does not entitle the Customer to a refund of the Fee for the stay.

III. Check-in and check-out from the cottage

  1. Your stay at the Cottage begins at 4:00 p.m. on the day of arrival and ends at 11:00 a.m. on the day of departure. If the Guest is not present at the Cottage after 11:00 a.m. on the day of departure, the Cottage staff has the right to enter the Cottage and move the Guest’s belongings to the reception desk.
  2. Early access to the Cottage on the day of arrival and extension of the stay in the Cottage depend on the current occupancy of the Cottage and are considered individually by the Landlord on a case-by-case basis.
  3. As part of the cottage reservation, the customer is entitled to a free parking space on the premises of “Jagodowa Osada.” The owner is not responsible for damage to or loss of the customer’s car.
  4. Check-in after 10:00 p.m. and check-out before 7:00 a.m. should be reported in advance and arranged with the cottage staff. Arrival/departure between 10:00 p.m. and 7:00 a.m. is subject to an additional fee of PLN 100.

IV. Customer Obligations

  1. The actual number of people staying in the Cottage is limited to the number specified in the reservation. The Customer is obliged to inform about any change in the number of people staying in the Cottage. If the Cottage is used in a manner inconsistent with the terms and conditions of the reservation, the Cottage staff may refuse to check in the customer and issue an access card to the Cottage. In such a case, the Customer is obliged to pay the full Fee for the stay, and if a Reservation Fee of 100% of the Fee for the stay has been paid, this fee is non-refundable.
  2. The customer is obliged to notify the cottage staff of any additional guests before arriving at the cottage. The cottage staff reserves the right to refuse additional guests if their total number exceeds the technical capacity of the cottage. Additional guests will be charged according to the arrangements between the customer and the cottage staff.
  3. The customer undertakes to observe the rules of good neighborliness. Quiet hours are in effect on the premises from 10:00 p.m. to 6:00 a.m. Failure to observe quiet hours will result in immediate eviction from the cottage without a refund of the accommodation fee.
  4. The customer and their guests are financially responsible for any damage or destruction of the cottage’s furnishings and equipment, including the tub, barbecue area, playground, and other public areas, whether intentional or unintentional.
  5. On the day of check-in, the customer is required to present a document with a photo confirming the customer’s identity to the cottage staff.
  6. The customer is obliged to immediately notify the cottage staff of any events that may expose the landlord to material damage or endanger the safety of customers or other guests staying at the cottage.
  7. The customer may not sublet the cottage.
  8. Children under three years of age who sleep in an adult’s bed or in their own cot and do not require bedding are not charged for their stay. Other children are charged according to the terms of the reservation.
  9. The organization of any events, in particular bachelor and bachelorette parties, is prohibited. In the event of such events being organized, the staff of the Cottages has the right to demand immediate departure from the Cottage. In such a case, the fee for the stay is non-refundable.
  10. Smoking tobacco and electronic cigarettes is strictly prohibited in the cottage.
  11. The Customer is solely responsible for all personal belongings of the Customer and guests located in the Cottage.
  12. The use of private heating devices is prohibited.
  13. A handling fee of PLN 200 will be charged for losing the access card to the cottage.
  14. Pets are not allowed.
  15. Customers may use the tub, barbecue, bonfire area, and playground in accordance with the rules set out in separate Regulations, which are available in each cottage.

V. Deposit

  1. On the day of check-in, the cottage staff will collect a refundable deposit of PLN 1,000 in cash from the customer. The customer will receive written confirmation of the deposit from the cottage staff. The deposit serves as security in the event of any damage, destruction, or shortages in the cottage’s interior and exterior equipment, as well as gross disorder or other violations of these Terms and Conditions.
  2. The deposit is returned to the Customer on the day of check-out after the staff has checked the condition of the Cottage upon check-out. If the Cottage and its interior and exterior equipment are in good condition, the deposit will be returned to the Customer.
  3. In the event of damage, missing items, destruction of the cottage and its equipment, both inside and outside, or in the event of gross disorder or other violations, the cottage staff has the right to deduct from the deposit an appropriate amount to cover the costs of repair, replacement, cleaning, or other expenses.
  4. In the event of damage exceeding the amount of the deposit, the Customer is obliged to cover it in full.
  5. The refund of the deposit may be withheld until the repair costs are documented, to which the Customer agrees.

VI. Cancellation of cottage reservations.

  1. In each case of booking, the Customer may choose to pay a Reservation Fee of 30% or 100% of the Stay Fee.
  2. If the Customer pays a reservation fee equal to 100% of the accommodation fee, the Customer is not entitled to cancel the reservation. In the event of cancellation, the reservation fee will not be refunded.
  3. If the Customer pays a Reservation Fee of 30% of the Stay Fee, the Customer has the right to cancel the reservation no later than 14 days before the planned date of arrival. In this case, the Reservation Fee will be refunded in full. Later cancellations will not be eligible for a refund of the Reservation Fee.
  4. Failure to use the entire stay in the Cottage in accordance with the reservation does not entitle you to a refund of the Stay Fee.

VII. Processing and protection of personal data

Detailed rules regarding the processing and protection of personal data, as well as cookies, are regulated by Privacy policy.

VIII. Complaints

  1. In case of any reservations regarding the quality of the cottages, complaints should be sent by email to: info@jagodowaosada.com
  2. Complaints will be responded to within 14 business days.

X. Final provisions

  1. The Lessor reserves the right to amend the Terms and Conditions. Such amendments will be published on the website. www.jagodowaosada.pl 
  2. The regulations come into force on the date of their publication.
  3. In matters not covered by these regulations, the provisions of the Civil Code shall apply.
  4. Any disputes between the Customer and the Lessor shall be settled in accordance with Polish law. The court competent to settle any disputes shall be the court competent for the Lessor’s registered office.

Follow these rules to ensure safe and responsible use of the playground.

Purpose of the playground:


Read these Rules and Regulations before using the playground. These rules and regulations are also available to guests in paper form in each cottage.
The playground at the “Jagodowa Osada” highlander cottages is exclusively for guests of this facility. It is for recreational use by children, only under adult supervision.
The equipment on the playground must be used according to its intended purpose and with the safety of the children playing in mind.
Use of the playground is subject to these Regulations.

Care:

Children must be supervised at all times on the playground equipment. Children left without adult supervision are not allowed on the playground. Legal guardians must ensure the safety of children on the playground.


It is guaranteed to be safe to use.

All elements of the playground must be used for their intended purpose. It is essential to adapt the use of individual devices to the child’s development. The child’s parent or guardian must complete the assessment.

The following actions are strictly forbidden:

These behaviors are strictly prohibited: climbing on structural elements not intended for this purpose, jumping from heights, using equipment in a manner that is dangerous to oneself or others, bringing sharp tools, glass, or potentially dangerous objects to the playground, bringing animals, smoking tobacco, e-cigarettes, and consuming alcohol, using the playground during bad weather conditions, such as storms, strong winds, rain, or snow.

Persons under the influence of alcohol or other intoxicating and psychotropic substances are strictly prohibited on the playground.

Order and cleanliness:

Keep the playground tidy. Dispose of trash in the appropriate containers.

 

Here’s a list of faults and reports.

If you notice any damage to equipment, surface elements, or other dangerous situations, contact the facility owner immediately. Damaged elements are strictly prohibited.

Responsibility:

The owner of the facility is not liable for accidents resulting from improper use of equipment, lack of supervision of children, or failure to comply with these Rules and Regulations. The playground is available to guests at their own risk. Parents or guardians of children are responsible for any damage to persons and/or property caused by children. Destruction of property located on the playground is subject to criminal liability.
Persons who violate these Rules and Regulations will be required to immediately cease using the playground.

RULES FOR LIGHTING BONFIRES

“Jagodowa Osada Settlement”

Bonfire location:

Before using the bonfire area, it is essential to read these Rules and Regulations. These Rules and Regulations are also available to guests in paper form in each cottage.
Bonfires may only be lit in a specially designated area that has been properly secured. It is forbidden to light fires in other areas not designated for this purpose.
Bonfires may only be lit at specific times, i.e. between 7:00 a.m. and 10:00 p.m., so as not to disturb the peace at night.

Wood:

Firewood is provided by the owner of the facility. It is forbidden to collect wood from the surrounding area and to burn waste, plastics, or hazardous materials.

Lighting and supervision:

Only adults are allowed to light a fire. The fire must not be left unattended. Water or a fire extinguisher should be kept nearby. When finished, the fire must be completely extinguished and the area around the fire must be cleaned up.

Weather conditions: It is prohibited to light a fire in strong winds or in conditions of high fire risk. If in doubt, please contact the owner of the facility.

Responsibility:

Guests of the “Jagodowa Osada” facility bear full responsibility for the bonfire, its course, and consequences. The owner of the facility is not responsible for accidents or damage resulting from improper use of fire.
In the event of failure to comply with these Rules and Regulations, guests of the “Jagodowa Osada” facility may be charged for the costs of damage and asked to leave the facility without the possibility of claiming a refund for their stay

RULES FOR USING THE HOT TUB

“BERRY SETTLEMENT”

General Rules
Before entering the garden tub (hereinafter referred to as the “Tub”), it is essential to read these Terms and Conditions.

Description of the tub: Each cottage has a tub for the exclusive use of the people renting that cottage. The tub has a hybrid heating system, i.e., electricity heats the water to a temperature of 5-10 degrees Celsius, and further heating is provided by a wood-burning stove. The tub is available for use by guests renting the cottage around the clock. Please use the tub with respect for the quiet hours and other guests.

Balia service:

Guests can prepare the Balia themselves using the Balia User Manual, available in paper form in each cottage. If guests wish to use the assistance of the staff, they should inform them in advance and arrange a convenient time.
The person renting the cottage is responsible for the operation of the Balia.
Improper operation of the Balia may lead to damage to the installation and pose a threat to health and life. The owner of the facility is not liable for damage related to improper operation of the Balia, arising from reasons beyond the control of the owner.
In the event of damage to the hot tub, the person indicated in point 2 will be charged with the costs of repairing the hot tub.

Hygiene and safety rules:

Adults can use the Hot Tube. Minors, or children under the age of 18, may use the tube only when accompanied by a parent or legal guardian. The legal guardian is responsible for the presence of the minor at the hot tube. Children under the age of 4 may not use the Hot Tube.


Before entering the Hot Tube, you must:
remove all metal objects
remove glasses or contact lenses
wash your entire body in the shower with soap
remove your shoes
While bathing in the Balii, it is forbidden to:
consume snacks and other food items
consume alcoholic beverages, drugs, and other intoxicants.
using liquids, essences, oils, or other substances
using glass objects
submerging your head and face
tampering with the nozzles, knobs, and other devices used to operate the Hot Tube
Be especially careful when entering and exiting the Balii, as the stairs and the surface inside the tube may be slippery.
Do not touch the stove or other elements used to operate the Balii, as they may be very hot and cause burns.
It is forbidden to place any objects (towels, bathrobes, etc.) on or near the stove.
A maximum of 6 people may use the hot tub at the same time. Exceeding the maximum number of people may damage or compromise the structure of the hot tub, which may result in personal injury.
When using the hot tub, it is recommended to heat the water to a temperature not exceeding 40 degrees Celsius.
The owner of the facility is not liable for any damage caused to persons using the hot tub in connection with failure to comply with the rules set out in points 4-8 above.
The hot tub may not be used by, among others:
People suffering from heart disease, hypertension, and blood vessel diseases;
People suffering from thyroid disease, claustrophobia, epilepsy, rheumatic conditions, cancer, acute infections and
asthmatic conditions;
Women who are pregnant or menstruating;
Those who have just completed intense physical training;
Those who have other contraindications due to their health condition.
If you feel unwell while in the tub, leave it immediately. 
If you have any health concerns, consult your doctor.
One session in the Hot Tube should last no longer than 10 minutes. After each session, cool your body with cool water. Rest for 10-15 minutes before the next session.
Staying in a heated Balia for a long time causes an increase in body temperature, which can be dangerous to your health.
You should be accompanied by another person in the Balia who can provide assistance, e.g., in case of fainting.
By entering the hot tub, the user confirms that their health condition allows them to use the hot tub. The owner of the facility is not liable for any damage, including health effects of staying in the hot tub, caused by reasons beyond the owner’s control.

Final provisions:

By using the Hot Tube, you are confirming that you have read and accepted all the provisions contained in these Terms and Conditions.

When using the Hot Tube, it is essential to follow the instructions for use.
In the event of failure to comply with the provisions of these Terms and Conditions, the owner of the facility has the right to ask the user to leave the Tube, without the possibility of claiming a refund for the costs of the stay.
These Terms and Conditions are also available to guests in paper form in each cottage for their review.
